As with all terms and conditions, these are a bit technical and we’re sorry if they sound rather formal. However, they are pretty standard and designed to enhance your e-shopping experience and make it as easy and secure as possible!

The webstore www.colorofblack.com ( hereinafter referred to as the "site”) is an electronic shop accessible to all internet users.

The company COLOR OF BLACK, 15 rue de LOUVOIS 31500 Toulouse, is registered at the French commercial register ( Registre du Commerce et des Sociétés de Toulouse) under the SIRET number 538 169 673 00018.

In the following terms and conditions of use , « we », « us » refer COLOR OF BLACK and “you” “your” refer to the customer.

In order to better serve its customers, we have opened a electronic shop that retails afro chic garments from different designers.

We would like to stress the fact that all orders are intended for products end users . Wholesale from our website is strictly forbidden. For all large or exceptional orders please directly contact us .

Placing an order implies the complete acceptance of the present terms and conditions which can be viewed at any time on the site, and more particularly, during the ordering process.

These terms and conditions are the sole contract between the parties and prevail over any other document. They can be modified at any moment.

The terms and conditions are applicable as soon as they are available on the site.

Photographs and other reproductions of the articles available on the Site are reliable, but only indicative and have no contractual value.

If you do not agree with those terms and conditions do not use this website.The present general conditions of sale apply to any sale via the website , identified by the domain name www.colorofblack.com .

Pricing

The prices displayed on the Site include all taxes, excepting shipping costs. The charged prices are those in effect at the date of the order.

The shipping costs for order delivery are automatically displayed after validation of the country by the customer and is again communicated to the customer in the order confirmation e-mail.

In accordance with the provisions of French legislation (article L.121-19, Code de la consommation), the customer also receives a written confirmation of the price and the shipping costs at order delivery.  

HOW TO PLACE AN ORDER ?

Orders will be received and accepted within the limits of available stock.

Should the ordered article be unavailable despite our vigilance, we will inform you as soon as possible by e-mail and reimburse the payment by crediting the customer’s credit card.

Online orders are made as follows:

First step:

Selection of articles by the customer The customer selects, enters and validates the product identification and quantity (the availability of which may need confirmation by the company) of articles.

These articles will be added to his or her “Basket”.

Second step:

Checking the selected articles The customer can change his or her “Basket” of selected articles by deleting articles from the “Basket”.

The prices of the articles are automatically displayed.

Third step:

Confirmation of selected articles and order validation: Once the customer has completed his or her selection and wants to validate the “Basket”, he or she is asked to identify themselves, by communicating name, address of regular residence (billing address), e-mail and phone number.

The customer is also asked to confirm the shipping address.The corresponding shipping costs will then be displayed. Finally, the payment mode must be specified. Once all this information entered and validated, the price and the corresponding shipping costs are displayed automatically. Once the authorisation to charge the customer’s account is given, the “Basket” is directly transferred to our order preparation department of, and the customer receives an e-mail containing the order number. The customer makes sure that all information communicated to us complies with the present general conditions of sale, and that it is complete and up-to-date.

During the order process, we collect personal data on the customer: identity, address of residence, shipping address . This information is necessary for order processing and can be handed over to our partners , particularly for the order execution.

In compliance with French legislation (loi informatique et libertés du 6 janvier 1978), the customer has the right to access, modify, rectify and remove his or her personal data.

The customer can exercise this right by accessing the section “My account” on the website.

Fourth step:

Acknowledgment of order registration by the Company, following the customer’s validation: Within a maximum of six (6) days (between 1 and 6 days) following the order registration, the Company acknowledges the order via an e-mail to the e-mail address given by the customer. In accordance with French legislation (art. 1369-2, Code civil) the customer formally accepts the use of electronic mail as means of order confirmation. This e-mail resumes all of the information given by the customer, and informs him or her on difficulties or restrictions that might have occurred regarding the order (availability of ordered articles, shipping delays, payment details). The e-mail mentions the order number attributed by us. Should the Company consider that the order does not comply with the present general conditions of sale (ex. wrong shipping address, exceeding the authorised number of articles), it informs the customer by e-mail, within the maximum of six (6) days mentioned above. Should the customer fail to rectify errors or order elements that do not comply with the present conditions of sale, we have the right to purely and simply cancel the order and the corresponding payment. We also have the right to refuse any order by a customer with whom a litigation regarding the payment of anterior orders is in course, or any order which does not comply with the present general conditions of sale.  

SECURED PAYMENT

The customer’s purchases are paid using PAYPAL system . PayPal is the preferred payment method for most customers. PayPal lets you send payments quickly and securely online using a credit card or bank account. When you send a payment using PayPal, the recipient won't ever see your credit card or bank account information.

Before you send a payment using PayPal:

You do not necessary need to have a PayPal account, but you can create one.

SHIPPING AND DELIVERY 

After the payment of the order has been registered, the article(s) are shipped to the shipping address specified by the customer.

In accordance with French legislation (article L.121-20-3, Code de la consommation), the article(s) is/are delivered within a maximum of 30 days following the order and/or within the delays mentioned in the order confirmation e-mail (sent 1 to 6 days after the customer’s order validation).

Items are shipped via Colissimo or UPS.

Shipping costs are based upon the shipping address and the service selected. In case the items delivered do not match your invoice please send us an email and return the items following the procedure mentionned below on the « Return and Exchange » section

RETURNS & EXCHANGES

Under the Distance Selling Regulations, you have 7 working days (beginning on the day after you receive their order) to exercise your right of withdrawal for your order with COLOR OF BLACK. In this case, COLOR OF BLACK will provide a full refund for your order but you must return the full order to us in their original packaging , new , unworn, unwashed the completed return form and a copy of the invoice. The order must be returned within 7 working days, from the date of reception of the order, at your own expense, to our main at the following address:

We will not accept any returns or exchanges beyond that limit . In order to keep proof of this return, the customer must send the articles via registered mail or any other means giving proof of the precise date of shipping.

Return shipping is paid by the customer. The goods will inspected once received by our services . If conditions of quality and time delay are met , we will give you back the amount you paid for the item, or offer an exchange, whichever you prefer, no questions asked within 30 days following the reception of the goods. Returned articles that are incomplete, damaged, deteriorated, or dirty will not be reimbursed totally and cannot give the right to a refund.

For hygiene reasons underwear and swimwear items cannot be returned nor exchanged.

LIMITATIONS OF LIABILITIES

More generally, we cannot be held responsible for:

Interruptions or delays on the Site due to maintenance work, technical problems, cases of force majeure, or due to third parties or any circumstances out of its control

The temporary impossibility for you or us to access the Site, due to reasons beyond their control, such as computer incidents, Internet network interruptions or dysfunctions of the customers’ Internet access devices.

We take the greatest possible care to give the most precise information and description of articles, available online on the Site or, as well as regarding their regular update. However, we can not be held responsible for non-substantial errors that might occur.

FORCE MAJEURE

We are not liable for failure to perform our obligations if such failure is as a result of Force Majeure Events.

A Force Majeure Event shall include any act, event, non-happening, omission or accident beyond our reasonable control and shall include in particular (without limitation) the following:

fire, flood, earthquake, storm, hurricane or other natural disaster

war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared)

DISPUTES - APPLICABLE LAW

These terms and conditions are to be construed in accordance with the laws of France and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the French courts.
